Hypothetical example: a Granby manager’s proposed U.S. transfer depends on a corporate restructuring. Signing the agreement may precede the date ownership and control actually change. Show the qualifying organizations and the applicant’s duties at the relevant times instead of using the future chart as the present structure. An L-1A review should create two dated records: one for corporate ownership or control and one for the applicant’s employment and authority. This reveals whether a transaction was complete at the relevant time and whether the claimed role is supported by actual delegation, staffing, budgets, and operations rather than by a senior-sounding title. Use the review sheet as a decision tool: it should show what can be proved today, what needs confirmation, and which commitment must wait. That discipline prevents a later explanation from being asked to repair a fact that should have been documented before the route was selected. Before acting, name the next verifiable step and the document that will confirm it. This turns preparation into a measured decision rather than an assumption that an attractive plan will answer an independent legal condition. Keep that decision log with the file so later changes can be compared with the evidence available when the route was chosen.

Distinguish signature from the effective relationship

Read closing conditions, effective dates and ownership records together. Identify the organizations before and after the transaction and evidence of when rights actually pass. A signed announcement does not necessarily establish the completed qualifying relationship. Avoid treating every restructuring as either an automatic break or automatic continuation of eligibility. Document a restructuring in layers: legal transaction, ownership record, and actual business activity. A signed announcement may be useful context but cannot replace proof of a completed qualifying relationship. Explain who performs ordinary operational work so the claimed U.S. role can be evaluated as managerial or executive on its actual duties.

Keep the employment and role evidence distinct

Assess the required continuous qualifying year of foreign employment in the relevant three-year period using the actual employers and duties. L-1A requires managerial or executive capacity, not simply a title in the new structure. Describe who exercises authority, what operational work others perform and the responsibilities the applicant will genuinely hold. The decisive operational evidence may be a staffing chart read with payroll, job descriptions, contracts, and budget authority. Explain the level at which the applicant will make decisions and who performs the underlying service. This prevents an executive label from masking a role that is primarily individual production.

Document business operations through the change

The parent, branch, subsidiary or affiliate relationship must exist while both qualifying entities actively do business. For a new office, establish sufficient physical premises and an operation able to support a managerial or executive role within one year; initial approval is limited to one year. Any principal offsite placement must not be labour for hire, and the petitioner must retain control. L-1A status is capped at seven years. An ownership closing does not itself prove operating readiness or automatically extend immigration authorization. Confirm the continuous qualifying foreign year in the three years before filing and calendar the L-1A seven-year maximum separately. A new office initially receives no more than one year and must show premises and an operation able to support the role. Preserve operating proof as the business develops for the later extension review.
