WATERLOO · TITLE WITHOUT CREDENTIAL

An employer letter that gives a job title and nothing else

THE SHORT ANSWER

Hypothetical example: a registered nurse from Waterloo, Quebec receives a support letter that names her position and start date and says nothing about the qualification the listing requires or the professional duties she will perform. The letter is polite and useless. It leaves the reviewer to guess which listed profession is intended and on what basis the applicant qualifies, and guessing is not how these decisions go well. The concrete decision is whether the employer can document the actual professional engagement now, or whether the role needs clarification before any request is made. Hypothetical example: a soil-science consultant has a strong résumé but an offer that never identifies the professional work; the employer must choose between supplying specific duties or postponing the application.

01

Ask for the elements the rule actually needs

A letter that supports a TN application should identify the employer, name the profession as it appears in the professional list rather than as an internal job grade, describe the professional duties in specific terms, state the period of the engagement, and set out the arrangement between the parties. Where a licence is the qualifying instrument, the letter should say so and identify the issuing regulator. Send the employer a short list of the elements needed rather than a request to improve the letter, because a general request usually produces a longer document that still omits the same things. Match each duty to the selected listing before collecting credentials.

02

Keep the credential evidence with the letter

The letter explains the engagement; it does not establish the qualification. That comes from the instrument the listing names — a degree, or a state or provincial licence, or in some entries a defined combination of a diploma and experience. Where a licence is relied on, obtain the regulator’s own confirmation of standing rather than relying on a wallet card. Where the qualifying degree was issued outside Canada, Mexico or the United States, the regulation calls for a reliable foreign-credential evaluation, which is separate from a translation. Documents in French submitted to USCIS need complete English translations with the translator’s certification. Use original issuer records when a qualification, licence, or name change is in question.

03

Check the conditions the letter cannot fix

Some elements do not depend on the employer at all. The applicant must hold Canadian or Mexican citizenship; permanent residence does not qualify. Entry must be temporary, and the work must be prearranged professional activity within a listed profession. If the applicant holds an ownership interest in the U.S. enterprise receiving the services, that must be disclosed, and sole ownership or control makes the arrangement self-employment, which the category does not permit. A Canadian citizen applies at a port of entry or through an employer petition. A dependant in TD status may study but may not work. Check ownership and supervision facts separately; a support letter cannot cure a prohibited arrangement.
