The list is closed, and it is the first gate
TN admits a citizen of Canada or Mexico to perform prearranged business activities within one of the professions set out in Appendix 2 of Chapter 16 of the USMCA. That appendix is a fixed enumeration, not a description of what counts as professional work. Environmental consultant and environmental scientist are absent from it, along with several occupations people expect to find there, including speech-language pathologist, paramedic, dental hygienist and every skilled trade. A profession that is missing cannot be reached by re-titling the position, by adding a degree, or by an employer's letter asserting that the role is professional in character. Reading the appendix itself, rather than a summary of it, is the first thing worth doing.
Look at the activity again before abandoning the route
The right second question is what Mireille would spend her week doing, described without the employer's label. If the work is laboratory analysis of water samples carried out in direct support of a chemist or a biologist employed by the same firm, the appendix entry for Scientific Technician or Technologist may be in reach; that entry has an unusual rule of its own, resting on theoretical knowledge of a listed scientific discipline and the ability to apply it to practical problems, rather than on a degree. If the work is principally client advice, business development and report writing, no listed entry describes it and the honest conclusion is that TN is the wrong instrument. Redrawing the position so that it genuinely consists of listed work is legitimate; describing it as something it is not is not.
Procedure, self-employment and the people travelling with her
If a listed profession is eventually identified, the mechanics are straightforward. A Canadian citizen ordinarily presents the application at a land port of entry or at a preclearance facility and needs no visa stamp; alternatively the U.S. employer files Form I-129 and she enters on the approved petition. A Mexican citizen generally applies for a TN visa through a consular post first. TN does not permit self-employment in the United States, so a plan in which she invoices the Vermont company through her own Québec corporation fails regardless of the profession question, and any ownership interest she takes in the U.S. entity must be disclosed and examined. Her spouse and children would hold TD status: they may live and study in the United States, and they may not work.
