Hypothetical example: a Granby applicant proposes using an insurance settlement for EB-5. Establish what the payment compensates, who is legally entitled to it and whether any amount is restricted or owed elsewhere. An insurer’s estimated amount is not the same as unrestricted proceeds already received. An EB-5 review should first create a lawful-source and funds-path ledger. Identify the legal owner of each amount, the transaction that produced it, every transfer, and its entry into the new commercial enterprise. This keeps a promising project separate from the proof needed to show capital, job creation, and later residence milestones. Use the review sheet as a decision tool: it should show what can be proved today, what needs confirmation, and which commitment must wait. That discipline prevents a later explanation from being asked to repair a fact that should have been documented before the route was selected. Before acting, name the next verifiable step and the document that will confirm it. This turns preparation into a measured decision rather than an assumption that an attractive plan will answer an independent legal condition. Keep that decision log with the file so later changes can be compared with the evidence available when the route was chosen.

Explain the entitlement and payment record

Preserve the policy or claim basis, settlement agreement, named recipients and actual disbursements. Identify restrictions, deductions and other parties’ rights without assuming every insurance payment has the same treatment. Trace the lawful source and path into the proposed investment. If the settlement is paid directly to an authorized recipient, explain that route rather than inventing an intermediate account movement. Read the investment documents for the actual risk of loss, deployment of capital, and job method. A projected distribution is not the same as qualifying capital. Keep the immigration calendar separate: petition approval does not itself give residence, and a project cash event cannot create a conditional-residence date.

Apply the EB-5 capital and job requirements

Current general investment thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustment beginning January 1, 2027. Qualifying capital must be invested at risk and support at least ten qualifying full-time jobs for qualifying U.S. workers per investor under the applicable rules. The investor must engage in management or policy formulation. Direct and regional-center job methods differ. Receiving a settlement does not establish these later investment elements. Separate the investor’s capital record from the project’s job evidence and from the family’s later process. Each has a different source document and date. This order helps identify whether a missing item concerns lawful funds, qualifying deployment, employment creation, or an individual immigration step.

Track the residence process separately

The investor petition is followed by the applicable immigrant-visa or adjustment process, subject to individual eligibility and visa availability; petition approval alone is not residence. The investor, spouse and unmarried children under 21 may obtain two-year conditional permanent residence. Form I-829 is generally due within the 90 days before the second anniversary of obtaining conditional residence to request removal of conditions. Neither the insurance payment date nor a project return date starts that filing window. EB-5 requires capital at risk and the required job showing, with residence initially conditional. Calendar investment evidence, the immigrant-visa or adjustment step, and Form I-829. The request to remove conditions uses a statutory pre-anniversary filing period tied to conditional residence, rather than the investment date or a repayment forecast.
