Hypothetical example: a Granby employee uses a detailed internal handbook but did not write it. L-1B preparation should explain the knowledge the employee actually possesses and applies. Authorship can be relevant evidence, but neither writing a manual nor merely having access to it decides the specialized-knowledge question. An L-1B review should connect the employee’s past assignments to the knowledge needed in the U.S. assignment. Identify the organization-specific method, the training, the practical application, and the reason the receiving operation needs the employee. A confidential manual can describe a process, but it does not by itself demonstrate the worker’s advanced or special knowledge. Use the review sheet as a decision tool: it should show what can be proved today, what needs confirmation, and which commitment must wait. That discipline prevents a later explanation from being asked to repair a fact that should have been documented before the route was selected. Before acting, name the next verifiable step and the document that will confirm it. This turns preparation into a measured decision rather than an assumption that an attractive plan will answer an independent legal condition. Keep that decision log with the file so later changes can be compared with the evidence available when the route was chosen.

Explain capability beyond access to a document

Identify the methods used, the situations handled and the applicant’s actual level of knowledge. L-1B includes special knowledge of the organization’s interests and their international application, or advanced knowledge of its processes and procedures. A handbook can describe a process without proving that everyone with a copy has qualifying knowledge. Use actual work episodes to show the employee’s capability: a difficult fault resolved, an internal sequence adapted, or a transfer performed with limited supervision. Choose only the confidential material needed to explain the point. The corporate relationship and qualifying foreign employment remain separate requirements even where the knowledge narrative is strong.

Attribute experience without inventing authorship

Describe training, practical application and responsibilities accurately. Use records that distinguish routine following of instructions from the knowledge relied on for the proposed U.S. role. There is no universal requirement that the applicant invented the method or holds unique proprietary knowledge. Do not add authorship merely because it sounds stronger. Compare the proposed U.S. duties with the precise knowledge described in the file. The question is not whether the employer values the employee, but whether the assignment will use the organization-specific capability claimed. An accurate limited explanation is safer than a broad assertion that every experienced worker is irreplaceable.

Support the transfer and proposed use

Document a parent, branch, subsidiary or affiliate relationship with both entities actively doing business, plus the required continuous qualifying year abroad in the relevant prior three-year period. Connect the employee’s company-specific specialized knowledge to the actual assignment. A new office requires sufficient premises and financial ability to pay the employee and begin doing business; initial approval is limited to one year. Any principal offsite placement must not be labour for hire and must remain controlled by the petitioner. L-1B status is capped at five years. Confirm the continuous qualifying foreign year in the three years before filing and calendar the L-1B five-year maximum separately. A new office begins with no more than one year and must have premises plus capacity to remunerate the worker and start business. A later redesign should be treated as a possible material fact, not a retroactive explanation.
