Hypothetical example: Wanjiru is a Kenyan citizen with Canadian permanent residence, working as a psychologist and living in Saint-Alphonse-de-Granby. Her citizenship ceremony is scheduled for the spring. An American employer wants her sooner, and somebody has told her that eleven years of residence is as good as a passport. It is not, for two routes; it is irrelevant, for two others. Knowing which is which lets her decide whether to wait for the ceremony or to stop waiting.
The two routes that turn on nationality
The treaty professional route reaches citizens of Canada or Mexico and nobody else. A permanent resident card, however long held and however settled the life behind it, does not open it, and there is no equivalence argument to be made. The treaty investor route also turns on nationality, but on a different question: the investor and the enterprise must have the nationality of a country with the relevant treaty. For Wanjiru today that means Kenya's treaty position, not Canada's, would decide it. Both of these change on the day she is naturalized, and neither changes a day earlier, whatever her residence history shows.
The routes that never asked about her passport
Intracompany transfer is indifferent to nationality. What it asks is whether there is a qualifying corporate relationship between two entities that are both doing business, whether she has one continuous year of qualifying employment abroad within the preceding three years, and whether her duties are managerial, executive or built on specialized knowledge of the employer's own systems. The immigrant investor route is likewise nationality-neutral: it asks for qualifying capital at risk, a lawful source and path, ten full-time jobs for qualifying American workers, and engagement in management or policy formulation. If either fits her circumstances, the ceremony date stops being the constraint.
Say which fact you are stating, on every form and at every counter
Citizenship and permanent residence answer different questions and get confused most often by people who have held one of them a long time. On any American form, in any letter and in any conversation with an officer, Wanjiru should describe herself as a citizen of Kenya who is a permanent resident of Canada, in that order, because that is what the documents show. Overstating it is a misrepresentation with consequences far worse than a refusal. If she does wait for the ceremony, the certificate and then the passport are the documents that change the analysis, and an offer letter dated before them should be reissued afterwards.
