Planning a new office around the effective date of a corporate restructuring

USAvisa field guide · 3 minute read Reviewed 7 September 2026
THE SHORT ANSWER

Hypothetical example: a Granby company may secure premises before a transaction creates the planned organization structure. Explain when the qualifying relationship exists and when the operation is ready; one event does not prove the other. Use this guide to decide which fact must be proved before money is spent or travel is arranged. A new-office L petition requires qualifying organizations, the relevant foreign employment, secured premises, and evidence that the new operation can support the claimed role. Hypothetical example: a theatre-lighting controls manufacturer with a sublease but no operating proof must separate an appealing plan from the record that actually establishes eligibility. The practical decision is whether the necessary evidence exists now, needs to be obtained, or points to a different route.

01

Establish the current qualifying organizations

Use ownership records and actual effective dates rather than only the signed announcement. Document one continuous qualifying year abroad within the three years before the petition and a parent, branch, subsidiary or affiliate relationship. Both entities must satisfy the applicable active-doing-business requirements, subject to the new-office rules. A future relationship diagram should remain marked as future until supported by the relevant event. Any client-site assignment must remain under the petitioner’s control and cannot be labour-for-hire; L-1A status is capped at seven years. Start with a one-page fact list: the identity of the person or business, the claimed route, the condition that controls, and the source record. A first review should produce a clear yes, no, or unresolved result for each item. That makes the next decision concrete instead of leaving it to a general impression.

02

Support the office and the proposed role

New-office evidence includes sufficient physical premises. For L-1A, the operation must support a managerial or executive position within one year, and initial new-office approval is limited to one year. Explain who performs routine work, what authority the applicant holds and the concrete resources behind the forecast. A lease alone does not establish the managerial role. Arrange documents in the order of the decision: source record, translation where required, transaction or employment proof, and a short explanation of any discrepancy. Preserve original dates and names. A later summary cannot quietly repair a missing link, and a private expectation cannot replace an official or contemporaneous record.

03

Keep delays in the right calendar

Record whether a delay affects ownership, occupancy, staffing or the applicant’s transfer. Update the evidence for the affected element rather than assuming every delay has the same legal consequence. A commercial extension does not automatically extend authorized stay. Review material changes before relying on a prior submission account or the original first-year milestones. Sequence commitments only after the governing condition and decisive records are identified. Review material changes before relying on an earlier plan, and keep government charges, private advice, business spending, and travel costs distinct. The careful choice is often to obtain one missing document before making a commitment that the record cannot support.
