SHEFFORD · A new company name is not a family status document

Keeping family authorization records separate from an employer’s revised paperwork

USAvisa field guide · 3 minute read Reviewed 7 September 2026
THE SHORT ANSWER

Hypothetical example: A Granby household preparing for a corporate change should identify which records merely update an employer’s name and which immigration records govern each person’s stay and activities. Do not treat the commercial paperwork as an automatic family authorization. Use this guide to decide which fact must be proved before money is spent or travel is arranged. Dependent eligibility, relationship evidence, age, intended activity, and the principal’s process stage must be assessed separately. Hypothetical example: a violin-restoration specialist relocating with a spouse and a twenty-year-old child must separate an appealing plan from the record that actually establishes eligibility. The practical decision is whether the necessary evidence exists now, needs to be obtained, or points to a different route.

01

Identify present permissions for each person

Canadian citizenship and Canadian permanent residence are separate facts, and a PR card does not establish TN eligibility. TD permits study but not employment. Qualifying E and L spouses may work incident to valid dependent status with applicable evidence; children do not receive that spouse permission. A professional licence or a foreign source of wages does not replace immigration authorization for work performed in the United States. Each family member’s intended activity must be matched to that person’s own status or route. Start with a one-page fact list: the identity of the person or business, the claimed route, the condition that controls, and the source record. A first review should produce a clear yes, no, or unresolved result for each item. That makes the next decision concrete instead of leaving it to a general impression.

02

Review immigration changes on their actual facts

A corporate name change, ownership transaction and employer change are not necessarily the same event. Obtain review of what actually happened and its effect on the principal and dependants. Keep individual classification and validity records visible rather than inferring that everyone’s status was automatically updated when the employer issued a new letter. Arrange documents in the order of the decision: source record, translation where required, transaction or employment proof, and a short explanation of any discrepancy. Preserve original dates and names. A later summary cannot quietly repair a missing link, and a private expectation cannot replace an official or contemporaneous record.

03

Use the correct sequence if the family pursues residence

For immigrant-visa entry, derivatives generally enter with or after the principal. Canadian citizenship and permanent residence are separate facts; a PR card does not establish TN eligibility. Review each person’s intended activity under that person’s actual status. Children generally age out of dependent eligibility at 21, subject to any applicable statutory protection assessed on individual dates. A petition approval or investment payment is not itself residence. Do not assume a business closing freezes eligibility. Keep travel and employment commitments tied to the process and authorization actually obtained. Sequence commitments only after the governing condition and decisive records are identified. Review material changes before relying on an earlier plan, and keep government charges, private advice, business spending, and travel costs distinct. The careful choice is often to obtain one missing document before making a commitment that the record cannot support.
