Checking the recipient and purpose before choosing an investor payment

THE SHORT ANSWER

Hypothetical example: A Granby applicant should be able to identify which payment goes into a qualifying investment and which goes to the government under Gold Card. An international transfer’s size or a private intermediary’s invoice does not establish its legal purpose. Use this guide to decide which fact must be proved before money is spent or travel is arranged. EB-5 uses capital at risk and job creation with conditional residence, while Gold Card is a gift payment by the applicant and not a conventional visa. Hypothetical example: a marine-survey entrepreneur with proceeds from a business sale must separate an appealing plan from the record that actually establishes eligibility. The practical decision is whether the necessary evidence exists now, needs to be obtained, or points to a different route.

Identify EB-5 capital and the later residence steps

Current general EB-5 thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustment beginning January 1, 2027. Capital must have a lawful source and path, remain at risk and meet the requirement for at least ten full-time jobs for qualifying U.S. workers per investor. The investor must engage in management or policy formulation. Petition approval is not residence; the investor, spouse and unmarried children under 21 may obtain two-year conditional permanent residence, followed by removal of conditions and Form I-829 generally filed in the 90 days before the second anniversary. Start with a one-page fact list: the identity of the person or business, the claimed route, the condition that controls, and the source record. A first review should produce a clear yes, no, or unresolved result for each item. That makes the next decision concrete instead of leaving it to a general impression.

Identify the current Gold Card official charges

As checked September 7, 2026, the official FAQ states US$15,000 nonrefundable processing per person, then after successful vetting a US$1 million individual principal gift or US$2 million corporate employee gift. Each eligible joining spouse or unmarried child under 21 adds US$15,000 and US$1 million, including corporately. Corporate terms include 1% annual maintenance and 5% transfer including a new check. Verify current instructions and additional visa or medical charges before payment. Arrange documents in the order of the decision: source record, translation where required, transaction or employment proof, and a short explanation of any discrepancy. Preserve original dates and names. A later summary cannot quietly repair a missing link, and a private expectation cannot replace an official or contemporaneous record.

Reconcile the payment without promising the outcome

Gold Card gifts go to the government and are not EB-5 investments offered for commercial return. Gold Card is an official program framework rather than a conventional standalone visa category; successful cases use EB-1 or EB-2 subject to category eligibility, admissibility and visa availability. Preserve official instructions and receipts separately from private service costs, and re-verify the official gift-plus-fee terms before any money moves. Neither a bank confirmation nor a large total payment proves immigration approval. Sequence commitments only after the governing condition and decisive records are identified. Review material changes before relying on an earlier plan, and keep government charges, private advice, business spending, and travel costs distinct. The careful choice is often to obtain one missing document before making a commitment that the record cannot support.
